Public Liability Policy
The Company will Indemnify the Insured against all sums which the Insured shall
become legally liable to pay in respect of :
(a) Accidental bodily injury to any person (other than a person employed under
a contract of service or apprenticeship with the Insured where the Injury
arises out of and in the course of such employment or a member of the family of
the Insured).
(b)Accidental damage to property (other than property actually owned by the
Insured or held in trust by the Insured or in his custody or control or upon
which the Insured or the employees of the Insured are or have been working or
the foundations of any building or other structure in the vicinity of any work
undertaken by the Insured).
Caused on or about the premises or contracts or other place or places described
in the Schedule as the situation of the risk through the fault or negligence of
the Insured or Persons in the service of the Insured or of sub-contractors to
the Insured or their Employees or by any defect in the buildings ways works
machinery or plant connected with or used in the business of the Insured.
The Company will pay in addition :-
(I) All litigation expenses Incurred with the consent of the Company.
(II) All costs and expenses of litigation recovered by any claimant against the
Insured.
